High Court grants injunction to remove mobile home

Megan Thomas has been active and successful on behalf of Sedgemoor District Council in Somerset.  The Council sought an injunction in the High Court to secure removal of a residential mobile home from a horticultural unit which had been in place for over 20 years.  The High Court granted the injunction and required removal of the mobile home and its brick wall cradle within 6 weeks.

On another High Court matter, the Council were challenged by way of judicial review for granting planning permission for a 14 dwelling development in the centre of Cheddar in Somerset.  No condition had been attached to the planning permission requiring there to be prior site investigation for potential contamination.  Megan advised that a freestanding section 106 obligation be entered into with the landowners to require a prior site investigation to be carried out if  the planning permission was implemented.  The landowners entered into the agreement and the High Court dismissed the claim leaving the planning permission intact.
