Giles Atkinson represents local authority in challenge to Planning Inspector’s decision

Giles Atkinson represented the London Borough of Haringey in a successful section 289 challenge to an Inspector’s decision (3205531) in which the Inspector had misdirected himself as to the question ‘what is the building’ for the purposes of section 55(2)(a) TCPA and had erred in assessing the impact of the new development, not against ‘the building’ but against other buildings in the wider area, an immaterial consideration.
