“Self-employed” construction worker was an employee

Mukhtiar Singh has successfully argued on behalf of a Claimant that despite a written contract identifying the Claimant as self-employed, the reality of the relationship was that of a contract of employment.

As such, the Claimant could bring a claim for unfair dismissal; wrongful dismissal; unlawful deduction of wages and unpaid holiday leave.

The Claimant was successful and was awarded over £30,000 in compensation.
