The case of ELLITTS who was convicted of a series of robberies, rapes of two victims and murder prosecuted by RICHARD BARRACLOUGH KC leading HOWARD SEARLE has now been considered by the Court of Appeal on an Attorney Generals Reference.

The Court of Appeal (Stuart Smith LJ, Choudry J and Thornton J) considered the sentence imposed of 28 years  and six months to be unduly lenient in that it did not reflect the aggregate criminality of the offending. In particular the rapes of the two homeless women were not sufficiently reflected in the increase in the minimum term by only two years.

The minimum term was increased to 35 years.
