Outline permission for housing on allocated site quashed

Noemi Byrd successfully represented the claimant community group in a legal challenge to planning permission for housing on an allocated site. The LPA’s failure to publish a section 106 agreement before the planning permission itself was described by the judge as “an unexplained flagrant breach” and a “serious want of transparency” resulting in a quashing order.
