Jemima Lovatt (for the Applicant) and James Harrison (for the Interested Party) appeared in a judicial review challenge of a circuit judge’s decision not to extend custody time limits in a case where the original trial could not go ahead because defence counsel was unwell which impacted the trial judge’s availability. The High Court granted the judicial review finding that the circuit judge had erred in law and that his decision, that the unavailability of defence counsel and the impact that had on the trial judge’s availability could never amount to a good and sufficient cause, was a decision that no court acting reasonably could have reached.
