Giles Atkinson successfully represents the City Council in resisting a challenge to the Council’s decision to grant planning permission

R (Moakes) v Canterbury CC and Others [2025] EWCA Civ 927.  

Giles represented the City Council in the CA, successfully resisting a challenge to the Council’s decision to grant planning permission for a large new winery and warehouse in the Kent Downs AONB. 

The Council erroneously did not allow objectors to speak against the proposal at committee but this was found not to have caused prejudice to the claimant; further that the reasoning of the decision was adequate and that the Council had properly distinguished another decision about a winery in an AONB elsewhere that emerged at the same time as the Council’s decision.
