Financial remedy proceedings and variation of undertakings in final orders

August 12, 2015

Stephen Hockman QC and Jane Campbell appeared for the appellate wife in a case concerning the variation of undertakings in final orders in financial remedy proceedings.

The Court held that whilst undertakings can be varied they cannot be varied so as to revisit the primary territory of the original order. The extent to which they can be varied is limited.
