Danny Moore KC, leading Ben Irwin, Secures Acquittal in Complex Manslaughter Trial

Danny Moore KC and Ben Irwin represented a man who, alongside a co-defendant, was prosecuted for manslaughter. The prosecution alleged that the defendant had assaulted the victim causing him a subdural haematoma, the same victim was then allegedly assaulted 2 days later by the co-defendant.  The victim died from a subdural haematoma soon later.

There were two key strands to the defence case.

Firstly, a factual defence; it was argued that the defendant had acted in self-defence.

Secondly, an argument relating to causation. The prosecution and defence each called expert medical evidence and following cross examination of the prosecution experts and the calling of the defence experts the flaws in the prosecution case on causation were highlighted.

In due course a successful submission of no case was made. The prosecution declined to appeal the ruling and the defendant was acquitted upon the direction of the Judge.

The co-defendant was convicted of Manslaughter.

The case was tried by the Honourable Ms Justice Norton.
