Court of Appeal dismisses appeal by neighbours found guilty of blocking right of way and altering boundaries

Nicholas Baldock represented one of two Claimants who brought actions against neighbours who had blocked a right of way and altered boundaries. The Claimant won in the County Court obtaining all the relief sought together with indemnity costs. The Defendants, who were litigants in person at that trial, appealed on the basis that the procedure had been unfair and an adjournment should have been granted for reasons of ill health. They were represented by leading counsel in the Court of Appeal. The appeal was dismissed. The Court of Appeal considered the authorities on adjournments for ill health and also looked at the overall merits of the case in concluding that no injustice had been done.
