Alex Crichton-Miller Successfully Appeals Conviction for Indecent Exposure

The Appellant, PS, had been convicted of one count of indecent exposure by a District Judge in the Magistrates’ Court, and appealed to Maidstone Crown Court.
The Prosecution’s case was that PS had become embroiled in an argument outside a Youth Centre and had exposed his genitals to at least two young people.
Both complainants were under 18, and so sensitivity was required in order to ensure fair and effective questioning. In cross-examination, Alex successfully undermined the credibility of the allegation, drawing out the differences between the two Complainants’ accounts.
After a full day trial, at which PS and the Officer in the Case also gave evidence, the appeal was allowed and the indecent exposure conviction was quashed. The Court cited the “real doubt” caused by the inconsistencies between the two accounts as the principal reason for allowing the appeal.
Significantly for PS, the lengthy Sexual Harm Prevention Order that had been imposed as a result of the original conviction was also quashed.
