Waste company convicted of corporate manslaughter after trial prosecuted by Mark Watson KC and Peter Alcock

At Winchester Crown Court on 22 December 2022, after a trial lasting 4 weeks before Garnham J, FDS Waste Services Ltd was convicted of corporate manslaughter. The case concerned workplace transport failures resulting in the death of a migrant worker in December 2018. In addition, the company was convicted of a related health and safety offence and a subsequent breach of duty concerning the entrapment of another migrant worker in machinery in June 2020. The director of the company was also convicted of a related workplace transport offence under section 37 of HSWA 1974. Sentencing of both defendants has been adjourned until 2023.

Mark Watson KC and Peter Alcock were instructed by CPS Special Casework Division as part of a joint investigation by Dorset Police and HSE.
