Tom Dunn secures convictions in legally complicated driving fatality case following an 8 day trial at Maidstone Crown Court.

The principal allegation was one of causing death by careless driving arising out of a fatal collision on Church Road in Cliffe, in December 2021. The prosecution case was that the defendant struck and killed the victim in the early hours of 18.12.21 following a night out drinking in Rochester. The defendant did not stop at the scene but was traced to his home address by police several hours later at 5 am. When arrested, he appeared substantially intoxicated but regrettably was not at the stage breathalysed. He would later say that his presentation was the result of a hypoglycaemic attack and not alcohol. This required the prosecution to present expert evidence in relation to the defendant’s Type 1 diabetes to contradict his account on this issue. The prosecution case was further complicated by the police collision investigation report which concluded that the victim would have been exceptionally difficult to see at point of the collision.

Sentence will take place on 27 May 2026.
