Simon Taylor has prosecuted a London property developer (instructed by Mssrs Tuckers on behalf of the Health and Safety Executive) for a series of safety failings that led to an employee sustaining catastrophic spinal injury.
In June 2011 Habitat Construction LLP, a developer of premium London properties failed to get to grips with the management of the risk at their London site. As a consequence one of their employees fell from an unguarded second floor window and sustained injuries that left him without the use of the lower half of his body. The resulting investigation revealed multiple failings in relation to the training and selection of staff and work at height issues.
At the hearing at the Southwark Crown Court the company was fined £110,000.
