Planning Inquiry Concludes in Enforcement and Lawful Development Certificate Appeals

Dr Bowes appeared on behalf of the London Borough of Bromley at a public inquiry before the Planning Inspectorate, which concluded today. The proceedings concerned linked appeals against the refusal of a Lawful Development Certificate and the service of an Enforcement Notice in respect of a long-established commercial site in Kent. The inquiry required detailed consideration of a number of important planning law issues, including the evidential burden in lawful development certificate applications, operational development, planning units, immunity from enforcement, material changes in the character of land use, and the planning status of extensive container-based storage.
