Leave Granted in Sexual Assault Appeal

D, a man of effective previous good character, had been convicted of historic sexual assaults and had received a sentence of imprisonment. He instructed new solicitors and applied for leave to appeal against his convictions. This application was refused by the Single Judge. On the advice of Oliver Saxby QC, this application was renewed to the full court; and, yesterday, having heard full oral argument, the Court of Appeal was persuaded to grant leave. The point centred around the admissibility of a piece of evidence not originally part of the Crown’s case. The full appeal will take place early in the New Year.
