Victoria Kaye, instructed by Bedfordshire Police, successfully applied to dismiss an appeal pursuant to s.297 of the Proceeds of Crime Act 2002 (“POCA”), securing the continued detention of £57,775 seized during an investigation into the supply of class A drugs and money laundering.
The Applicant applied for the return of £10,000 from the total seized, claiming it was an inheritance from a deceased relative. The cash had been discovered at the property in vacuum-sealed bundles and alongside large quantities of drugs.
The court dismissed the appeal, finding reasonable grounds to suspect the cash was both recoverable property and intended for unlawful conduct under s.295(5) and (6) POCA. The investigations continue.
