Dr Michael Bowes has successfully represented a claimant in proceedings before the Hastings County Court arising from the recovery of a loan made through an international foreign exchange trading platform.
The case involved a cross-border payment in which loaned funds were transferred into an overseas trading account, later subjected to unapproved conversion into cryptocurrency.
The dispute raised issues concerning contractual certainty, the legal effect of third-party communications, and the enforceability of a potential variation. Consideration was also given to a separate international litigation against the FX platform where the money had been deposited. The court was required to scrutinise the evidential weight of a unilateral agreement and determine the enforceability of repayment terms.
Judgment was entered in favour of the claimant for the full sum requested.
